Scope and Consent

This User Privacy Policy ("Privacy Policy") applies to your use of any Ticket Fulfillment Group powered by Ticket Evolution site, associated websites (collectively, the “Sites”), and associated applications and tools (collectively, the “Services”) where this Privacy Notice is referenced, regardless of how you access or use them, including through mobile devices. By using the Sites and/or Services, you consent to the use of your Personal Information in accordance with this Privacy Policy.  

This Privacy Policy describes:

• The Personal Information we collect and how we use that information;
• The choices you have about how we communicate with you and what Personal Information you share;
• When we might disclose your Personal Information; and
• How we retain and protect your Personal Information.

Ticket Fulfillment Group powered by Ticket Evolution is responsible for the collection, use, disclosure, retention and protection of your Personal Information in accordance with our data privacy practices described herein as well as any applicable laws. If you provide Personal Information Off-Line to Ticket Fulfillment Group powered by Ticket Evolution, the current Privacy Policy also applies.

Data Collection

Personal and Other Information Collected

Information you provide us on our Sites or through our Services.

While using the Sites or Services you are deemed to have unambiguously and freely provided us with your Personal Information. “Personal Information” refers to data that on its own or in combination with other information can identify you as a specific individual. Ticket Fulfillment Group powered by Ticket Evolution only collects Personal Information that is necessary for legitimate business and legal purposes. Access to your Personal Information is restricted to those Ticket Fulfillment Group powered by Ticket Evolution personnel who need access to provide the Services and third-party entities that are under contract with Ticket Fulfillment Group powered by Ticket Evolution.

Personal Information and or information that you may provide:

• Registration information to create a user account, including name, physical address, email address, telephone and/or mobile phone number;
• Financial information such as credit card, or debit card numbers (provided using industry standard encryption or other secured transmission);
• Transactional information based on your activities on the Sites and through our Services;
• Shipping, billing and other information you provide to purchase tickets;
• Recordings of telephone communications (provided that appropriate notice and consent has been obtained for recording in accordance with applicable laws);
• Information provided through reviews, chats, dispute resolution, referral services; information added to a web form or when adding/updating your account information; correspondence through our Sites and Services; or correspondence with our customer service team or correspondence sent to us.

Automatic Data Collection

By accessing our Sites or Services we collect automatic data regarding your visit in order to give you the best possible user experience. For example, the Sites use web measurement technology to track how visitors interact with the Sites including: where they come from, what they did on the Site, and whether they completed any pre-determined tasks while on the Sites. This type of information is only available to Ticket Fulfillment Group powered by Ticket Evolution personnel and our authorized agents or representatives under contract to Ticket Fulfillment Group powered by Ticket Evolution. The data may be aggregated to help Ticket Fulfillment Group powered by Ticket Evolution improve our user interface and diversify our content offerings to meet the needs of our customers, track operational problems, prevent fraud and improve the effectiveness, security, and integrity of the Sites.

Current Automatically Collected Data:

• Log Information: We collect information about your use of the Sites or Services, including: type of browser, page views, IP Address, browsing history;
• Device Information: Device ID or Unique Identifier, device type, ID for unique device token.
• Geo-location information, including location information from your mobile device (Please note: most mobile devices allow you to disable location services in the settings app.)
• Computer and connection information.
• Statistics on page views, traffic to and from URL sites, referral URL, ad data, IP address, browsing history and web log information.

For fraud prevention purposes, information is stored and passed securely to third party fraud prevention software.

Ticket Fulfillment Group powered by Ticket Evolution also receives and records non-Personal Information and stores this data on our servers.

Personal Information from other sources

• We may supplement the information we collect or auto-collect from you when using or Sites or Services with information we obtain from third parties and add it to your account information. This may include publicly available demographic information; additional contact information, user information or account information (including third-party account information) and other information required to verify you or your business' identity and to assess possible fraud.
• We may allow you to share information with third-party social media sites or use social media sites to create your account or to connect your account with the respective social media sites. Those social media sites may give us access to certain of your Personal Information stored by them (e.g., your profile, content viewed, content liked by you, and information about the advertisements within the content you have been shown or may have clicked on, etc.). You control the Personal Information you allow us to have access to through the privacy settings on any social media sites and the permissions you give us when you grant us access. By associating an account managed by a social media site with your Ticket Fulfillment Group powered by Ticket Evolution account and authorizing us to have access to this information, you agree that Ticket Fulfillment Group powered by Ticket Evolution may collect, use and store the information provided by these social media sites in accordance with this Privacy Policy.

Choice

You have a choice about how we use your Personal Information to communicate with you and to send you marketing information.

Communication Preferences

When you open an account with us or otherwise conduct business with us via our Sites or Services, you agree to receive marketing or promotional messages from us, such as via email or text. We may provide your Personal Information to third parties for their marketing purposes. If you do not wish to receive such marketing or promotional communications from our Sites and Services or any third party, you’ll be provided an option to opt-out or indicate your preferences on these messages. If you have agreed to receive marketing communications through checkout with our partners, you must change your communication preferences with them directly.

However, you may not opt-out of receiving administrative messages, customer services responses or other transactional communications from us.

Withdraw Consent

If you withdraw your consent for the use or disclosure of your Personal Information for the purposes set out in this Privacy Policy, you may not have access to all of our Sites and Services available to our users and authorized under this Privacy Policy and our User Agreement. Use and Retention

We use the Personal Information we collect to: operate, improve and personalize our Sites and Services, to contact you about your account or our Sites and Services, provide you customer service, customize our marketing, to detect, prevent and mitigate fraudulent or illegal activities and to comply with our legal obligations. You agree that we may use your Personal Information as follows:

• Use of the Sites (browsing);
• Purchase a product;
• Register with a Site or Services;
• Communicate with us via the Sites, Services or Off-Line;
• Emails and promotional materials;
• Customize, measure, personalize and improve our Services;
• Provide access to your personal sales history payment transaction history, internal correspondence and other features.

Sites and Services may also collect information using cookies, web beacons or similar technologies, or through third parties using similar technologies. For example, when you visit the Site and use the Services, we use certain essential cookies, such as session “cookies” — a piece of information stored on your computer — to provide you with the requested services available through our Sites and to use some of its features, such as access to secure areas. Because these cookies are strictly necessary for the Sites’ functionality, you cannot refuse them without impacting your experience. Users who do not accept cookies or disable their web browsers’ ability to accept cookies will still be able to browse the Site but may not have full functionality.

We may also use other analytics providers to collect non-Personal Information to help us improve our Site and Services and your user experience.

We retain Personal Information we collect for as long as necessary to fulfill the purposes for it was collected, including to satisfy any legal, accounting or reporting requirements.

Data Access

We take steps to ensure that the Personal Information we collect is accurate and up to date, and that you have the ability to access or correct it.

Where you have a legal right to request access or request the modification or erasure of information, we may still withhold that access or decline to correct information in accordance with applicable law but will give you the reasons if we do so.

Disclosure

We disclose Personal Information to satisfy an order, respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect the rights, property or safety of any member of the Ticket Fulfillment Group powered by Ticket Evolution Inc. corporate family, other users or third parties. Such information will be disclosed only in accordance with applicable laws and regulations. We minimize the amount of Personal Information we share to what is directly relevant and necessary to accomplish the specified purpose. We may disclose your Personal Information with:

• Members of Ticket Fulfillment Group powered by Ticket Evolution, Inc. to provide joint content and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, to guide decisions about their products, sites, applications, tools, services and communications. Members of our corporate family may use this information to send you marketing communications only if you have consented to their services and will use your Personal Information in compliance with their respective privacy policies.
• Third-party fraud prevention tools to assess and manage risk (including to help protect your account from fraudulent activity or alert you if we detect such fraudulent activity on your account), to provide customer services (including to help service your account or resolve disputes, e.g., billing or transactional), and to comply with anti-money laundering and counter-terrorist financing verification requirements.
• Third party agents, representatives and service providers, payment processors and financial institutions under contract who help with our business operations (such as, but not limited to, fraud detection and investigations, identity verification services, payment processing, bill collection, affiliate and rewards programs, website operations, fulfillment and delivery services or ticket cancellation and reissue services). These contracts will require that these third parties implement data privacy practices and security safeguards equal to or greater than set forth in with this Privacy Policy.
• Marketing partners for certain sites, events or listings where you agree during checkout that you would like your information shared for their marketing purposes. We may share your contact information and transaction data (excluding payment information) with the marketing partner identified in checkout. Information shared with a marketing partner is subject to their privacy policy. We do not control the privacy policies of marketing partners and we encourage you to review their privacy policies.
• Other Ticket Fulfillment Group powered by Ticket Evolution users, whether located in your country of residence or outside of your country of residence, as necessary or appropriate for the transaction or as authorized by your use of our Services. For example, when you purchase a ticket, a seller may receive your contact information and transaction data (excluding payment information) or other information that might be included on a ticket in order for the seller to complete the transaction or provide box office services. Such information is subject to the seller's privacy policy. We also partner with certain third parties who contract with us to access the Ticket Fulfillment Group powered by Ticket Evolution platform under a separate domain (“White Label Program Affiliates”). Ticket Fulfillment Group powered by Ticket Evolution and these White Label Program affiliates share Personal Information to provide the Services. These White Label Program affiliates are contractually required to adhere to this Privacy Policy.
• Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
• Local and foreign law enforcement or regulatory agencies, other government officials or authorized third-parties, in response to a verified request relating to a criminal investigation (i.e. a subpoena, court order or substantially similar legal procedure) or alleged or suspected illegal activity or any other activity that may expose us, you, or any other Ticket Fulfillment Group powered by Ticket Evolution user to legal liability, or if we believe in good faith that disclosure is necessary for the prevention or detection of crime, the capture or prosecution of offenders, or the assessment or collection of tax or duty. In such events, we will disclose information relevant and necessary to the investigation or inquiry, such as name, address, telephone number, email address, IP address, fraud complaints, sales and/or purchase history or payment transaction history.
• Third parties commencing, or involved in, a legal proceeding if they provide us with a subpoena, court order or similar legal document, or if such disclosure is necessary for the purpose of obtaining legal advice or is necessary for the purposes of establishing, exercising, or defending legal rights.

While we use contractual and other measures to ensure protection of Personal Information, the laws and regulations relating to privacy and Personal Information protection in other jurisdictions may not be the same as, or similar to your local privacy laws. The governments, courts, law enforcement or regulatory agencies in these other jurisdictions may be able to request disclosure of Personal Information through the laws of these countries. In an effort to respect your privacy, we will not otherwise disclose your Personal Information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm, financial loss or to report potentially illegal or fraudulent activity.

If we were to merge with or be acquired by another company, we may share information with them in accordance with our data privacy practices. Should such an event occur, we will require that the new combined entity follow this Privacy Policy with respect to your Personal Information. If your Personal Information will be used or disclosed for any purposes not covered in this Privacy Policy, your prior consent will be sought for the use of your Personal Information for the new purposes.

Security

We use industry standard technical and administrative safeguards to protect your Personal Information in order to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls, data encryption procedures, commercial software programs, and information access authorization controls.

Notice to EU/EEA Residents

If we collect the Personal Information of residents from the European Union (EU) or European Economic Area (EEA), we advise that your Personal Information will be transferred to and processed in the United States, which has data protection laws that are different than those in your country and may not be as protective. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

If we ask you to provide Personal Information to us to comply with a legal requirement or enter into a contract, we will inform you of this and let you know whether providing us with your Personal Information is required and if not, the consequences of not sharing your personal data with us.

Similarly, if we collect and use your Personal Information in reliance on our or a third party's legitimate interests and those interests are not already described above, we will let you know what those legitimate interests are.

We endeavor to apply suitable safeguards to protect the privacy and security of your Personal Information and to use it only consistent with your relationship with us and the practices described in this Privacy Policy. We also take steps to minimize the risk to your rights and freedoms by not collecting or storing sensitive or special categories of Personal Information about you.

We will respond to your request in a reasonable timeframe and in accordance with the law that applies to you. In most cases, revoking consent is prospective only. If you withdraw your consent you may no longer be able to access or use any of the Services.

Other Important Information

Using information obtained on Ticket Fulfillment Group powered by Ticket Evolution.com

Other users may have access to the information you share on the Site and Services (e.g. listings, ratings and reviews, business seller information) and may have access to other users' contact, delivery and transaction data as necessary to facilitate ticket purchases, sales and payment transactions. You may only use the Personal Information that you have access to for transaction-related purposes, for using services offered through Ticket Fulfillment Group powered by Ticket Evolution (such as delivery services) and for purposes expressly consented by the user to whom the information relates. Using Personal Information that you have access to for any other purpose, including marketing without appropriate consent, is a violation of our User Agreement and other policies.

Unwanted emails

Children's Privacy

Our Sites is for the general audience, and our Services are not intended for users under the age of 18. We do not knowingly collect Personal Information from users younger than 18. In the event that we learn we have collected any Personal Information from a child under the age of 18, we will delete that information from our database and terminate the corresponding account, if any.  If you are using our Sites or Services, you represent that you are 18 years of age or older.

Third-Party Privacy Practices

This Privacy Policy addresses only the use and disclosure of Personal Information we collect from you. If you disclose your Personal Information to others, their privacy notices and practices will apply. We cannot guarantee the privacy or security of your information once you provide it to a third party and we encourage you to evaluate the privacy and security policies of any third party before entering into a transaction and choosing to share your Personal Information.

Changes to this notice

The Privacy Policy put forth may be amended at any time. Notification of changes to this policy will be communicated via notice on Ticket Fulfillment Group powered by Ticket Evolution site, application, tool, or associated service. These changes will go into effect as of the date listed above.
